By accessing or using the TraderNewbie platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

TraderNewbie reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically for changes.

TraderNewbie is an online trading education platform that provides structured learning paths, simulated trading environments, AI-powered trade review, and community features. The Service is designed for educational purposes only and is intended to help users develop trading knowledge and skills in a risk-free environment.

The Service includes, but is not limited to:

  • Simulated trading environment using real market data

3. User Accounts

To access certain features of the Service, you must create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Update your information to keep it accurate, current, and complete
  • Maintain the security of your password and accept all risks of unauthorized access
  • Immediately notify TraderNewbie of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years of age.

4. User Responsibilities

You agree not to:

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of TraderNewbie and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TraderNewbie. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may share links to content on the Service through social media or other platforms

6. User-Generated Content

Our Service may allow you to post, link, and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you grant TraderNewbie a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content in connection with providing and promoting the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TRADERNEWBIE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Trading financial products involves significant risk, and you may lose more than your initial investment. Past performance in simulated trading does not guarantee future results in live trading. Simulated trading results are hypothetical and do not represent actual trading. Since the trades have not actually been executed, the results may have under- or over-compensated for the impact of certain market factors, such as liquidity. There are numerous other factors related to the markets in general or to the implementation of any specific trading program that cannot be fully accounted for in the preparation of hypothetical performance results.

8. Limitation of Liability

In no event shall TraderNewbie, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if TraderNewbie has been advised of the possibility of such damage.

9. Payment and Subscription

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on the pricing page. All fees are non-refundable unless otherwise stated in our refund policy.

TraderNewbie reserves the right to change its pricing at any time. Price changes will become effective at the end of the current billing period. We will provide notice of any material pricing changes at least 30 days in advance.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to deactivate your account.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the seat of arbitration shall be Wilmington, Delaware.

Before filing any arbitration, you agree to first contact us at legal@tradernewbie.com and attempt to resolve the dispute informally for at least 30 days.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in effect.
